Fun With FISA

August 7th, 2007 · 1 Comment

I’ve got an article up at Reason today about the weekend’s FISA amendment.

If you just can’t get enough, see also Tim Lee’s take at Ars Techica, Patrick Keefe at Slate, and Ryan Singel at Threat Level.

It seems like someone should mention that freely available implementations of public-key cryptography make any remotely competent terrorist pretty much invulnerable from any “wiretapping”, foreign or domestic. We don’t have to strike a balance between surveillance and privacy, because the NSA doesn’t have the power to decipher the communications of our enemies, not only because they are in Arabic, but because we don’t yet have computers that can boil oceans.
